Welcome to Community!

These Terms and Conditions ("Terms and Conditions" or “Terms”) govern your use of the Community application ("Community", “App”, “we”, “us”, or “our”), provided to you for the purpose of exploring and planning visits to photo exhibitions. By using the App, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you should not use the App.

1. USE OF THE APP

You may use the App to browse exhibitions, bookmark events, post impressions, give awards and participate in community interactions in accordance with these Terms.

2. AGE RESTRICTION

You must be at least 18 (eighteen) years of age to use the App. By accessing or using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into and be bound by these Terms. If you are under 18, you are strictly prohibited from creating an account, posting content, or using any of the App’s features.

Community does not knowingly collect or solicit information from individuals under the age of 18. In the event that we become aware that a user is underage, we reserve the right to immediately terminate the associated account and delete any related data. You acknowledge and agree that you are solely responsible for ensuring compliance with age restrictions in your jurisdiction and that Community bears no responsibility for any false statements or misrepresentations of age. Any such misrepresentation may result in account suspension, deletion of content, and, if required by applicable legislation, notification to legal authorities.

3. USER ACCOUNT

When You create an account with Community, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account and our services. You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password, whether your password is with our service or a third-party social media service. You agree not to disclose your password to any third party.

You must notify Community immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene. If you attempt to register as an artist, you must not impersonate any individual or organization, nor may you provide false or misleading information regarding authorship, affiliation, or ownership of works. Doing so constitutes fraud and may result in immediate account suspension and legal action where applicable.

4. USER CONTENT

The App may allow you to upload, post, or share content, including impressions, comments, and messages (“User Content”). You retain ownership of your User Content, but you grant Community a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content within the App. You are solely responsible for your content and agree not to post anything unlawful, harmful, or inappropriate.

If you choose to include links to your external social media or websites (including your artist page), these links will be publicly visible on your profile. We do not validate or monitor these links. You are solely responsible for any data shared through external services.

Community reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any User Content is appropriate and complies with this Terms, refuse or remove this User Content. Community further reserves the right to make formatting and edits and change the manner of any User Content. Community can also limit or revoke the use of the service if you post such objectionable User Content.

As Community cannot control all content posted by users and/or third parties on the service, you agree to use the service at your own risk. You understand that by using the service you may be exposed to content that you may find offensive, indecent, incorrect or objectionable, and you agree that under no circumstances will Community be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.

5. DATA COLLECTION AND USAGE

We collect limited data to improve the user experience — including exhibition views, bookmarks, subscriptions, and interactions with features such as Map, Calendar, and Postcards.

If you sign in via Open ID providers (such as Google, Apple, Yahoo! Japan, LINE, and others), we may receive your email address, provided you grant permission. This email is securely stored in Firebase and used exclusively for sending occasional updates or newsletters. You may unsubscribe at any time via the opt-out link in the email. We do not store or use names or surnames, even if shared by the identity provider.

We do not collect or store your precise GPS location. Location access is requested only temporarily to support features like route calculation or visit confirmation and is never stored or transmitted externally.

In accordance with the Act on the Protection of Personal Information (APPI), any information that could identify a specific individual — such as device identifiers, account IDs, or combined usage data — is treated with strict care. Users have the right to request access to, correction of, or deletion of their personal data.

6. LOCATION AND NAVIGATION

Location services are utilized exclusively to enhance location-dependent features within the App, such as determining the distance between your current position and nearby galleries, suggesting relevant exhibitions based on proximity, and verifying exhibition attendance during visits.

Your location is accessed temporarily and only when you actively engage with features that require it (e.g., route planning or attendance confirmation). All location processing occurs locally on your device — the App does not store, log, or transmit your location data to external servers or third parties.

We do not maintain continuous tracking, and location access can be managed or disabled at any time through your device’s system settings. Disabling location services may limit access to certain functionality but will not affect the overall use of the App.

7. COMMUNICATION AND MESSAGING

The App includes a basic messaging feature intended solely to facilitate coordination between users, such as sending exhibition invitations or organizing group visits. Please note that this messaging feature is NOT encrypted, and the content of your messages may be accessible during transmission. We strongly advise against using this feature to exchange any private, sensitive, or personally identifiable information.

Community is not liable for any consequences resulting from the misuse of the messaging feature or from sharing personal data through it. Users are expected to limit conversations to topics directly related to exhibitions, events, and coordination. Messaging must not be used for commercial promotion, harassment, or unsolicited communication of any kind. Abuse of this feature may result in account restriction or termination.

8. NOTIFICATIONS

We provide a comprehensive notification system to help you save time and stay informed about relevant updates. With your permission, the App may deliver push notifications to your device in the following cases: (i) when you subscribe to an artist; (ii) when you subscribe to a gallery; (iii) when you bookmark an exhibition or when a bookmarked exhibition is updated; (iv) when you receive new messages from other users; and (v) when Community publishes broadcasts.

You can manage your notification preferences at any time in the App’s Settings, including selecting specific categories to receive or disabling notifications entirely. The number of notifications you receive depends on your activity, subscriptions, and bookmarks; as a general guideline, we typically send no more than five (5) notifications per week. Delivery of notifications may depend on your device and operating system settings; disabling notifications at the system level will prevent delivery.

9. DATA STORAGE AND TRANSFER

The data collected through the App may be stored and processed on servers located outside of your country of residence, including in jurisdictions that may not have data protection laws equivalent to those in your home country. By using the App, you consent to such cross-border transfers of your personal data. For Japanese users, any transfer of personal data outside Japan will be handled in accordance with the Act on the Protection of Personal Information (APPI), ensuring equivalent levels of protection.

10. CONDUCT

You agree to use the App in a respectful, lawful, and non-disruptive manner at all times. This includes refraining from harassment, bullying, or intimidation of other users; avoiding the use of hate speech, discriminatory language, or explicit and offensive content; and not uploading or sharing any material that is defamatory, obscene, illegal, or violates the rights of others. The messaging feature must not be used for spam, unsolicited promotions, or personal attacks. You are prohibited from impersonating individuals, organizations, or artists, as well as from circumventing access controls, moderation systems, or any other security mechanisms integrated into the App.

Any attempt to compromise the App’s integrity, such as through hacking, reverse engineering, or exploiting vulnerabilities, is strictly forbidden. Users are also solely responsible for the content of the messages they send within the App. Community disclaims any liability for damages caused by offensive, threatening, or unlawful communications initiated by users, but reserves the right to remove such content and to suspend or permanently terminate the accounts of those responsible.

Community may monitor user behavior, content submissions, and communications to ensure compliance with these Terms and to maintain a constructive and inclusive environment for all participants. Repeated or serious violations may result in permanent account suspension, content removal, or referral to law enforcement authorities where appropriate.

11. CONTENT ACCURACY DISCLAIMER

While we make every reasonable effort to ensure that the information displayed in the App — including exhibition details, gallery hours, artist names, and venue locations — is accurate, complete, and up to date at the time of publication, Community cannot guarantee the absolute reliability or timeliness of such data. Much of the content presented in the App is sourced from third parties, such as galleries, curators, artists, or automated feeds, and may be subject to last-minute changes that are beyond our control.

We do not assume responsibility for outdated, incorrect, or missing information resulting from external submissions or delays in updates. Accordingly, Community does not provide any warranties, express or implied, regarding the accuracy, availability, or completeness of any content shown in the App. Users are strongly encouraged to verify the details of exhibitions — including start and end dates, opening hours, locations, and entry policies — by contacting the respective galleries, organizers, or artists directly prior to visiting. Community shall not be held liable for any inconvenience, loss, or misunderstanding resulting from reliance on the App’s exhibition data.

The App follows a policy of not publishing information about exhibitions related to ongoing or recent armed conflicts, military propaganda, incitement of ethnic or national hatred, political interpretations of war, romanticization of participants in military conflicts, or similar content. This restriction is implemented to maintain a respectful, neutral, and safe informational environment aligned with the mission of the App — to present cultural events, particularly within the fields of photography and art, rather than political or military subjects.

We reserve the right to decline the submission or remove any content (including exhibition posters, descriptions, images, messages, or external links) if such content contains elements or messaging that may be perceived as support for or romanticization of military actions, violence, or political aggression.

Users acknowledge and agree that any moderation decisions regarding such content are made at the sole discretion of the App administration, without any obligation to provide detailed explanations, as these decisions are intended to ensure user safety and adherence to widely accepted ethical standards.

12. INTELLECTUAL PROPERTY

The service and all of its original content — including, but not limited to, App design, user interface components, icons, layout structure, source code (except open-source components), images, graphics, branding elements, and text — are and shall remain the exclusive property of Community and its licensors.

All such content is protected under applicable copyright, trademark, and other intellectual property laws in Japan and other jurisdictions. Unauthorized reproduction, distribution, modification, reverse engineering, or use of any protected elements of the Service, whether for commercial or non-commercial purposes, is strictly prohibited without prior written permission from Community.

Any trademarks, service marks, trade names, logos, or trade dress appearing within the App are registered and/or unregistered marks owned by Community or third-party rights holders, and may not be copied, imitated, or used, in whole or in part, without express prior authorization. Nothing in these Terms grants you a license or right to use any of Community’s intellectual property without prior written consent.

13. INTELLECTUAL PROPERTY INFRINGEMENT

Community respect the intellectual property rights of others. It is our policy to respond to any claim that content posted through the service infringes copyright or other intellectual property rights. If you are a copyright owner or authorized to act on behalf of one, and you believe that any content available through the service infringes your copyright, you may submit a written notification to our copyright agent via email at support@communityapp.jp. Your notice must include a detailed description of the alleged infringement. Please note that you may be held liable for damages (including costs and attorneys’ fees) if you knowingly misrepresent that content is infringing your copyright.

14. THIRD-PARTY SERVICES

The App may include links or integrations with third-party services (e.g., maps, analytics, social media platforms). Community is not responsible for the content, terms, or privacy practices of these external services. You are encouraged to review the terms and policies of any third-party services before interacting with them through the App.

The App incorporates third-party tools and SDKs necessary to provide its features. These services are limited in scope and are integrated in a privacy-conscious manner. By using the App, you acknowledge the use of the following services:

Firebase Firestore: Used as a real-time cloud database to store exhibition bookmarks, impressions, and related app data. It is also used in conjunction with Firebase Authentication to manage Open ID-based login via third-party providers (e.g., Google, Apple, Yahoo! Japan, LINE). When you sign in, your email address (if permission is granted) is securely stored in Firestore and used exclusively for newsletter delivery. We do not store your real name, surname, or any additional personal data provided by these identity providers.
Google Maps SDK: Supports discovery of nearby exhibitions, navigation, and gallery search. The SDK may access temporary approximate location data but does not store or transmit user location history. For more information about Google Maps policies see links below.
Apple Maps: Used to construct routes from the user’s location to the gallery when requested. Coordinates are sent to Apple Maps only for navigation purposes and are not stored or collected by the App.
Third-Party Authentication Providers (Google, Apple, Yahoo! Japan, LINE, etc.): These services allow users to sign in securely using existing accounts. Upon authentication, we may receive an email address and a unique user identifier. The email address is used exclusively for optional newsletters and is never shared. The unique identifier is used internally to link your session or preferences but is not used for tracking or profiling. Your real name or display name (if shared) is not stored or used by our system.
TOCropViewController: Used locally to crop user-provided photos when creating avatars. No data from this feature is transmitted to external services.
SwiftSoup: Used internally to parse exhibition descriptions and rich content from exhibition feeds. It does not transmit or collect user data.
SwiftUIPager: Used internally to implement smooth photo scrolling. It handles UI layout only and does not collect or transmit any user data.
RichTextKit: Enables enhanced text formatting in user-generated content, such as impressions. This operates locally and does not involve external data processing or transmission.
Push Notifications: Used to send optional reminders, exhibition invitations, and updates. Notifications are only delivered with user permission and can be disabled in your device’s system settings.

15. TERMINATION

We reserve the right to suspend, restrict, or permanently terminate your access to the App at any time, with or without prior notice, if we determine, in our sole discretion, that you have violated these Terms, engaged in conduct that harms other users or the Community platform, or misused any part of the App or its features. This includes, but is not limited to, fraudulent activity, impersonation, abusive behavior, or posting unlawful or harmful content. Repeated offenses or serious violations may result in immediate account deactivation and deletion of any associated data.

Termination may also occur due to legal or regulatory requirements, or if continued access poses a security, legal, or reputational risk to Community.

16. LIMITATION OF LIABILITY

Community provides the App “as is” and disclaims any warranties, express or implied. While the App has undergone extensive testing and no issues were identified prior to its release, we do not guarantee uninterrupted or error-free operation. As with any software, unforeseen bugs or malfunctions may occur. You use the App at your own risk.

Community reserves the right to temporarily suspend, restrict, or disable the App at any time and for any reason, including but not limited to system maintenance, diagnostics, security patches, feature upgrades, or emergency interventions. In cases of scheduled maintenance, we will make reasonable efforts to inform users in advance. However, in urgent or unforeseen situations, service interruptions may occur without prior notice. We will always strive to minimize any negative impact on users, but cannot guarantee uninterrupted access or preservation of user experience during such periods.

Although regular backups of User Content are performed, Community does not guarantee there will be no loss or corruption of data. Corrupt or invalid backup points may be caused by, without limitation, User Content that is corrupted prior to being backed up or that changes during the time a backup is performed. Community may provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of User Content. However, you acknowledge that Community has no liability related to the integrity of User Content or the failure to successfully restore User Content to a usable state.

17. PLATFORM PROVIDER DISCLAIMER

Community is not responsible for the policies, practices, or actions of platform providers, including but not limited to Apple Inc. and Google LLC. These providers may impose their own terms of service, privacy policies, and operational requirements which are beyond Community’s control.

We disclaim all liability for any disruptions, removals, or limitations to the App that result from decisions or enforcement actions by such platform providers. This includes, but is not limited to, temporary unavailability, app rejection or suspension, or required changes to comply with updated platform policies. Users are encouraged to review the respective platform terms that govern their use of the App.

18. JAPAN AND UNITED STATES LEGAL COMPLIANCE

You represent and warrant that (i) you are not located in, or using the App from, a country that is subject to a trade embargo or other sanctions imposed by the government of Japan and/or the United States of America (the “US”), including but not limited to those countries officially designated as “terrorist supporting” or otherwise restricted; and (ii) you are not listed on any government-issued list of prohibited or restricted individuals or entities, including but not limited to the Specially Designated Nationals (SDN) list maintained by the US Department of the Treasury or any equivalent list issued by Japanese authorities.

Use of the App in violation of these restrictions is strictly prohibited and may result in immediate account termination and notification to appropriate authorities.

19. FORCE MAJEURE

Community shall not be held liable for any delay, disruption, or failure in performance resulting from causes beyond its reasonable control, whether foreseeable or unforeseeable. Such causes include, but are not limited to, natural disasters (such as earthquakes, floods, or storms), government actions or regulations, acts of war or terrorism, labor disputes or strikes, power outages, failures in telecommunications or internet services, technical malfunctions, pandemics, or public health emergencies.

In such events, Community may suspend or limit access to the App temporarily without liability. Where feasible, we will make reasonable efforts to notify users in advance of any anticipated disruptions. However, in urgent or unforeseen situations, advance notice may not be possible. We will strive to minimize the impact on users to the extent reasonably possible, but no guarantees can be provided.

20. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Japan. If versions in different languages exist, the Japanese version shall prevail in case of any inconsistency.

21. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable under applicable law, the remainder of the Terms shall remain in full force and effect.

22. PRIVACY POLICY

By using the App, you also agree to our Privacy Policy, which governs the handling of your personal data. The current version of our Privacy Policy is available at any time via the User Settings screen in the App.

23. CHANGES OF TERMS

We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.

これらの利用規約（以下「本規約」）は、写真展の閲覧および訪問計画を目的として提供されるCommunityアプリケーション（以下「Community」「本アプリ」「当社」など）のご利用に適用されます。本アプリを使用することにより、ユーザーは本規約に同意したものとみなされます。もし同意できない場合は、本アプリをご利用にならないでください。

1. アプリの利用

ユーザーは、本規約に従って、展示の閲覧、イベントのブックマーク、印象の投稿、賞の贈呈、コミュニティでの交流を行う目的で本アプリを利用することができます。

2. 年齢制限

本アプリを使用するには、18歳以上である必要があります。アプリにアクセスまたは使用することにより、ユーザーは自分が18歳以上であり、本規約に法的に拘束される能力を有していることを表明・保証するものとします。18歳未満の方は、アカウントの作成、コンテンツの投稿、またはアプリの機能の使用を一切禁止します。

Communityは、18歳未満の個人から情報を意図的に収集または勧誘することはありません。万が一未成年のユーザーが判明した場合、当社は当該アカウントを即時に終了し、関連データを削除する権利を有します。ユーザーは、各自の管轄地域における年齢制限を遵守する責任を負うことに同意し、Communityは虚偽の年齢申告について一切の責任を負いません。虚偽の申告が発覚した場合、アカウント停止、コンテンツ削除、また必要に応じて法的機関への通報が行われる可能性があります。

3. ユーザーアカウント

Communityでアカウントを作成する際は、常に正確かつ完全で最新の情報を提供しなければなりません。これに違反した場合、本規約の重大な違反とみなされ、アカウントおよびサービスが即時に停止される可能性があります。

パスワードの管理はユーザー自身の責任であり、第三者による使用であっても責任を負うものとします。他人にパスワードを開示してはなりません。

セキュリティ違反や不正使用に気づいた場合は、直ちにCommunityに連絡してください。ユーザー名には、他人や法人の名前、許可のない商標、または不適切・卑猥・攻撃的な言葉などは使用できません。アーティストとして登録する場合、他人や団体になりすましたり、著作権、所属、所有権について虚偽または誤解を招く情報を提供したりしてはなりません。これらは詐欺行為に該当し、アカウント停止や法的措置が取られる可能性があります。

4. ユーザーコンテンツ

本アプリでは、ユーザーが印象、コメント、メッセージなどのコンテンツ（以下「ユーザーコンテンツ」）をアップロード、投稿、共有できる場合があります。ユーザーコンテンツの所有権はユーザーにありますが、ユーザーはCommunityに対して、非独占的かつロイヤリティフリーで全世界における使用、複製、表示のライセンスを付与するものとします。ユーザーは自らのコンテンツに対して全責任を負い、違法、有害、不適切な内容を投稿しないことに同意します。

外部SNSやウェブサイト（アーティストページを含む）へのリンクをプロフィールに掲載する場合、それらは公開されます。当社はこれらリンクの確認・監視は行いません。外部サービスを通じて共有される情報に関しては、ユーザーが単独で責任を負うものとします。

Communityは、ユーザーコンテンツが適切で本規約に準拠しているかどうかを独自の裁量で判断し、投稿を拒否または削除する権利を有しますが、その義務を負いません。また、形式の修正や編集、表示方法の変更を行う権利も有します。不適切と判断されるコンテンツを投稿した場合、サービス利用を制限または取り消すことができます。

Communityは、ユーザーや第三者が投稿するすべてのコンテンツを管理することはできません。そのため、ユーザーは自己の責任において本サービスを利用するものとします。サービス利用により、不快、不正確、わいせつ、または不適切と感じるコンテンツに接する可能性があることを理解し、これらのコンテンツに関して、Communityは一切の責任を負わないことに同意します。

5. データの収集と利用

当社は、ユーザー体験を向上させるために、展示の閲覧履歴、ブックマーク、購読、地図・カレンダー・ポストカードなどの機能とのインタラクションを含む、限定的なデータのみを収集します。

Google、Apple、Yahoo! Japan、LINEなどのOpen IDプロバイダーを通じてサインインする場合、ユーザーが許可した場合に限り、メールアドレスを受け取ることがあります。このメールアドレスはFirebaseに安全に保存され、時折お知らせやニュースレターを送信する目的のみに使用されます。メール内の配信停止リンクから、いつでも配信を停止することが可能です。認証プロバイダーから共有された実名や姓については、保存も利用もしません。

当アプリでは、正確なGPS位置情報を収集・保存しません。位置情報へのアクセスは、経路計算や訪問確認などの特定機能を一時的にサポートする目的に限られ、情報は保存または外部送信されません。

個人情報保護法（APPI）に基づき、デバイス識別子、アカウントID、使用データの組み合わせなど、個人を特定できる可能性のある情報は慎重に取り扱われます。ユーザーは、自身の個人データへのアクセス、修正、削除を要求する権利を有しています。

6. 位置情報とナビゲーション

本アプリでは、現在地と近くのギャラリーとの距離の測定、近隣の展示の提案、来場時の出席確認など、位置情報に基づく機能を向上させるためにのみ位置情報サービスを使用します。

位置情報は、ルート案内や出席確認など、位置情報を必要とする機能をユーザーが明示的に使用した場合にのみ一時的に取得されます。すべての位置情報処理はユーザーのデバイス上でローカルに行われ、Communityは位置情報を外部サーバーや第三者に保存、記録、送信することはありません。

継続的な位置追跡は一切行われておらず、位置情報へのアクセスはお使いのデバイスの設定でいつでも管理または無効にできます。位置情報サービスを無効にすると一部機能が制限される可能性がありますが、アプリ全体の利用には影響しません。

7. 通信およびメッセージ機能

本アプリには、展示の招待やグループ訪問の調整など、ユーザー同士の連携を支援するための基本的なメッセージ機能が含まれています。ただし、このメッセージ機能は暗号化されておらず、送信中にメッセージ内容が第三者に見られる可能性があります。個人情報や機密情報の送信には使用しないでください。

Communityは、メッセージ機能の誤用または個人情報の共有によって生じた損害に対して一切責任を負いません。メッセージ内容は展示、イベント、調整に関するものに限定することが期待されています。営業活動、迷惑行為、または無断連絡等にこの機能を使用することは禁止されており、違反があった場合はアカウント制限または停止となる可能性があります。

8. 通知

当アプリでは、ユーザーの時間を節約し、関連する最新情報を確実に把握できるよう、包括的な通知システムを提供しています。お客様の許可に基づき、次の場合にデバイスへプッシュ通知を送信することがあります：(i) アーティストを購読したとき、(ii) ギャラリーを購読したとき、(iii) 展覧会をブックマークしたとき、またはブックマーク済みの展覧会が更新されたとき、(iv) 他のユーザーから新しいメッセージを受信したとき、(v) Community がブロードキャスト（お知らせ）を公開したとき。

通知の受信設定はアプリの「設定」でいつでも管理できます。受け取るカテゴリの選択や通知の完全オフも可能です。受信件数はお客様のアクティビティ・購読・ブックマークにより異なりますが、目安として通常は 1 週間に 5 件以内です。通知の配信はご利用のデバイスおよび OS の設定に依存する場合があり、システムレベルで通知を無効にすると配信されません。

9. データの保存と移転

本アプリを通じて収集されたデータは、ユーザーの居住国以外のサーバーに保存・処理される可能性があります。これには、日本とは同等の個人情報保護法が存在しない地域も含まれます。アプリを使用することにより、ユーザーはそのような越境データ移転に同意したものとみなされます。

日本のユーザーに対しては、個人情報の国外移転は「個人情報保護法（APPI）」に基づき、同等の保護水準が確保される形で行われます。

10. 行動規範

ユーザーは、常に敬意を持ち、合法的かつ秩序を乱さない方法で本アプリを利用することに同意するものとします。これには、他のユーザーに対する嫌がらせ、いじめ、脅迫をしないこと、ヘイトスピーチや差別的な表現、露骨で不快なコンテンツの使用を避けること、名誉毀損、わいせつ、違法、または他者の権利を侵害する素材をアップロード・共有しないことが含まれます。

メッセージ機能は、スパム、無断プロモーション、個人攻撃の目的で使用してはなりません。他人、団体、アーティストになりすます行為、アクセス制御やモデレーション、セキュリティ機能の回避も禁止されています。

アプリの完全性を損なう行為（ハッキング、リバースエンジニアリング、脆弱性の悪用など）は厳禁です。ユーザーは送信したメッセージの内容についても全責任を負います。Communityは、ユーザーによる不快、脅迫的、または違法な通信によって発生した損害に対して責任を負いませんが、そのようなコンテンツの削除および該当アカウントの一時停止または永久停止を行う権利を有します。

Communityは、すべてのユーザーにとって健全で包括的な環境を維持するため、ユーザーの行動、投稿、通信を監視する場合があります。重大または繰り返しの違反があった場合、アカウントの永久停止、コンテンツの削除、または必要に応じて法的機関への通報が行われる可能性があります。

11. コンテンツの正確性に関する免責事項

Communityでは、展示情報、ギャラリーの営業時間、アーティスト名、会場の所在地など、本アプリ内に表示される情報が正確・完全かつ最新であるよう努めていますが、その正確性や即時性を完全に保証することはできません。

アプリ内の多くのコンテンツは、ギャラリー、キュレーター、アーティスト、または自動フィードなどの第三者から提供されており、直前に変更される場合があります。当社は、外部からの提出や更新の遅延に起因する誤情報や不足情報について責任を負いません。

したがって、Communityはアプリ内のコンテンツの正確性、可用性、完全性について、明示的または黙示的ないかなる保証も行いません。ユーザーは、展示の詳細（開始・終了日、開館時間、所在地、入場方針など）を訪問前に各ギャラリーや主催者、アーティストに直接確認することを強く推奨します。アプリの情報に依拠して生じた不便、損失、誤解について、Communityは一切の責任を負いません。

本アプリは、現在または最近の武力衝突に関連する展示情報、軍事プロパガンダ、民族的・国家的憎悪を煽る内容、戦争の政治的解釈、軍事紛争参加者の美化、その他類似の内容については掲載しないという厳格な方針を採用しています。これは、本アプリの使命である「写真やアートなどの文化的イベントを紹介すること」に沿い、政治的または軍事的なテーマではなく、尊重・中立・安全な情報環境を維持するために実施されています。

また、掲載申請があったコンテンツ（展示ポスター、説明文、画像、メッセージ、外部リンク等を含む）が、軍事行為や暴力、政治的侵略の支持または美化と受け取られる可能性がある要素やメッセージを含む場合、掲載を拒否または削除する権利を当アプリは留保します。

ユーザーは、このようなコンテンツに関するモデレーション判断が、本アプリ運営側の単独裁量により行われ、詳細な説明義務がないことを認識し、同意するものとします。これらの判断は、利用者の安全確保および広く受け入れられている倫理基準の遵守を目的としています。

12. 知的財産権

本サービスおよびそのすべてのオリジナルコンテンツ（アプリデザイン、ユーザーインターフェース構成要素、アイコン、レイアウト構造、ソースコード（オープンソースを除く）、画像、グラフィック、ブランド要素、テキストなどを含むがこれらに限られません）は、Communityおよびそのライセンサーの専有財産であり、今後もそれが継続されます。

これらすべてのコンテンツは、日本およびその他の法域における著作権法、商標法、その他の知的財産関連法によって保護されています。商業目的・非商業目的を問わず、Communityの事前の書面による許可なしに、当該保護対象のコンテンツを複製、配布、改変、リバースエンジニアリング、または使用することは禁止されています。

13. 知的財産権の侵害について

Communityは、他者の知的財産権を尊重します。サービス上に投稿されたコンテンツが著作権またはその他の知的財産権を侵害しているとの申し立てに対しては、適切に対応する方針です。

もしあなたが著作権者、またはその代理人であり、本サービスを通じて提供されているコンテンツが著作権を侵害しているとお考えの場合は、support@communityapp.jp 宛に著作権担当者まで、詳細な侵害内容を明記した書面でご連絡ください。なお、虚偽の申し立てを行った場合、損害賠償（弁護士費用などを含む）の責任を問われる可能性があります。

14. サードパーティサービス

本アプリには、地図、分析ツール、ソーシャルメディアなどのサードパーティサービスへのリンクまたは統合が含まれる場合があります。Communityは、これら外部サービスの内容、利用規約、またはプライバシー慣行について一切責任を負いません。これらのサービスと連携する前に、各サービスの利用規約やポリシーをご確認いただくことを推奨します。

本アプリは、必要な機能を提供するために以下のサードパーティ製ツールおよびSDKを統合しています。これらのサービスは限定的な範囲で使用され、プライバシーに配慮した形で導入されています。アプリを使用することにより、以下のサービスの使用に同意したものとみなされます。

Firebase Firestore: 展示のお気に入り登録、インプレッション、その他のアプリ関連データをリアルタイムで保存するクラウドデータベースとして使用されます。また、Google、Apple、Yahoo! Japan、LINEなどのサードパーティプロバイダーを通じたOpen IDベースのログイン管理にもFirebase Authenticationと併用されます。サインイン時に、許可された場合はメールアドレスがFirestoreに安全に保存され、ニュースレター配信のみに使用されます。これらの認証プロバイダーから提供される実名や姓、その他の個人情報は保存しません。
Google Maps SDK: 近隣の展示の発見、ナビゲーション、ギャラリー検索を支援します。SDKは一時的なおおよその位置情報にアクセスする場合がありますが、位置履歴を保存または送信することはありません。詳細はGoogle Mapsのポリシーをご確認ください。
Apple Maps: ユーザーの現在地からギャラリーまでのルートを作成するために使用されます。座標はナビゲーションのためにのみApple Mapsに送信され、アプリ側では保存または収集されません。
サードパーティ認証プロバイダー（Google、Apple、Yahoo! Japan、LINEなど）:これらのサービスにより、ユーザーは既存のアカウントで安全にサインインできます。認証後、メールアドレスおよび一意のユーザー識別子を受け取る場合があります。メールアドレスはニュースレター配信のみに使用され、第三者と共有されることはありません。一意の識別子は、セッションや設定の紐づけのみに内部的に使用され、追跡やプロファイリングには使用されません。実名や表示名が共有された場合でも、当システムでは保存または使用されません。
TOCropViewController: アバター作成時に、ユーザーが提供した画像をローカルでトリミングするために使用されます。この機能からのデータは外部に送信されません。
SwiftSoup: 展示説明やフィードからのリッチコンテンツを解析するために内部的に使用されます。ユーザーデータの送信や収集は行われません。
SwiftUIPager：ユーザーがスムーズに写真をスクロールできるようにするために内部で使用されます。UIレイアウトのみを処理し、ユーザーデータの収集や送信は行いません。
RichTextKit: 印象などユーザー生成コンテンツのテキスト装飾をサポートします。ローカルで動作し、外部処理や送信は行われません。
Push Notifications: 展示リマインダー、招待、アップデートなどを通知します。通知はユーザーの許可がある場合にのみ送信され、デバイス設定からいつでも無効化できます。

15. 利用停止・アカウント終了

Communityは、ユーザーが本規約に違反した場合、他のユーザーまたはCommunityプラットフォームに損害を与えた場合、またはアプリやその機能を不適切に使用したと判断した場合には、予告の有無にかかわらず、いつでもアクセスの一時停止、制限、またはアカウントの永久終了を行う権利を留保します。これには、不正行為、なりすまし、攻撃的な行動、違法または有害なコンテンツの投稿などが含まれます。重大または繰り返しの違反は、アカウントの即時無効化および関連データの削除につながる可能性があります。

また、法的・規制上の要請、またはセキュリティ、法的、評判リスクがあると判断された場合にも、利用停止が行われることがあります。

16. 責任の制限

Communityは、本アプリを「現状のまま」提供しており、明示または黙示を問わず一切の保証をいたしません。本アプリはリリース前に十分なテストを行っておりますが、常時稼働またはエラーのない運用を保証するものではありません。すべてのソフトウェアと同様、予期せぬ不具合やバグが発生する可能性があります。ユーザーは自己責任で本アプリをご利用ください。

Communityは、システムメンテナンス、診断、セキュリティパッチ、機能アップグレード、緊急対応など、いかなる理由でも本アプリを一時的に停止、制限、または無効にする権利を有します。予定されたメンテナンスの場合は、事前にユーザーへ通知するよう努めますが、緊急時や予期しない事態では事前通知なく中断が発生することがあります。当社は影響を最小限に抑えるよう努力しますが、常時アクセスや快適な利用体験の継続を保証するものではありません。

ユーザーコンテンツの定期的なバックアップは実施していますが、Communityはデータの損失または破損が発生しないことを保証するものではありません。破損や無効なバックアップは、バックアップ前に既に破損しているデータや、バックアップ中に変更されたデータなどに起因する場合があります。Communityは、既知の問題に対するサポートや復旧対応を試みることがありますが、ユーザーコンテンツの整合性や完全な復元について責任を負いません。

17. プラットフォーム提供者に関する免責事項

Communityは、Apple Inc. や Google LLC を含むプラットフォーム提供者のポリシー、運用、または行動について責任を負いません。これらの提供者は独自の利用規約、プライバシーポリシー、運用要件を設けており、Communityでは制御できません。

これらプラットフォーム提供者の判断や実施によって発生する中断、制限、アプリの削除等について、Communityは一切の責任を負いません。これには、一時的な利用不可、アプリの拒否や停止、またはプラットフォームポリシー変更への適合が求められるケースなどが含まれます。ユーザーはアプリ利用に関わるプラットフォーム側の利用規約を確認することを推奨します。

18. 日本および米国の法令遵守

ユーザーは以下を表明し、保証するものとします：(i) 日本政府および/またはアメリカ合衆国（以下「米国」）政府による貿易制裁または制限措置の対象国（いわゆる「テロ支援国家」など）に居住しておらず、またそこから本アプリを利用していないこと；(ii) 米国財務省が管理するSpecially Designated Nationals (SDN) リストまたは日本政府が発行する同等の禁止・制限リストに含まれていないこと。

これらの制限に違反して本アプリを使用することは厳しく禁止されており、アカウントの即時停止および関係当局への報告の対象となる場合があります。

19. 不可抗力

Communityは、予見の有無を問わず、合理的に制御できない要因（天災地変、地震、洪水、暴風、政府の措置、戦争、テロ、労働争議、停電、通信障害、インターネットの不通、技術的な障害、パンデミック、公衆衛生上の緊急事態など）による遅延、中断、または履行不能について、一切の責任を負いません。

このような状況では、Communityはアプリへのアクセスを一時的に停止または制限することがあります。可能な限り事前に通知するよう努力しますが、緊急時や予期できない事態では通知できない場合もあります。影響を最小限に抑えるよう努めますが、完全な保証はいたしません。

20. 準拠法および裁判管轄

本規約は、日本法に準拠し、これに従って解釈されるものとします。複数の言語版が存在する場合、不一致がある場合には日本語版が優先されます。

21. 分離可能性

本規約のいずれかの条項が無効または執行不能と判断された場合でも、その他の条項は引き続き有効に存続します。

22. プライバシーポリシー

アプリを利用することにより、ユーザーはCommunityのプライバシーポリシーにも同意したものとみなされます。最新版は、アプリ内のユーザー設定画面からいつでも確認できます。

23. 利用規約の変更

Communityは、本規約を随時変更する権利を有します。変更後もアプリの利用を継続することにより、ユーザーは更新後の規約に同意したものとみなされます。

本条款与条件（以下简称“条款”）适用于您使用 Community 应用程序（以下简称“Community”、“本应用”、“我们”）的行为，该应用旨在帮助用户探索和规划参观摄影展。使用本应用即表示您同意遵守这些条款。如您不同意，请勿使用本应用。

1. 应用的使用

您可以根据本条款，使用本应用浏览展览、收藏活动、发布感想、赠送奖章，并参与社区互动。

2. 年龄限制

您必须年满18周岁才能使用本应用。使用或访问本应用，即表示您确认并保证自己年满18岁，并具备法律行为能力接受并遵守本条款。如未满18岁，严禁创建账户、发布内容或使用任何功能。

Community不会有意收集或征求18岁以下个人的信息。如我们发现某用户未满18岁，有权立即终止其账户并删除相关数据。您须自行确保符合所在地区的年龄限制，Community对虚假年龄陈述不承担任何责任。若发现虚假信息，可能会导致账户暂停、内容删除，必要时将依法报告相关部门。

3. 用户账户

在 Community 创建账户时，您必须提供真实、完整且及时更新的信息。若违反此项条款，我们有权立即终止账户及服务。

您需妥善保管密码，并对密码下的所有活动负责，无论该密码用于本服务或第三方服务。请勿将密码透露给他人。

如发现安全漏洞或账户被未经授权使用，应立即通知 Community。禁止使用他人姓名、法人名称、注册商标、或任何冒犯性、低俗、不当内容作为用户名。如您以艺术家身份注册，严禁冒充他人或组织、虚假声明作品的作者、归属或所有权，违反者将面临账户暂停或法律责任。

4. 用户内容

本应用允许您上传、发布或分享内容，包括感想、评论和消息（“用户内容”）。您保留对用户内容的所有权，但您授予Community在全球范围内对该内容的非独占、免版税的使用、复制和展示许可。您对自己的内容全权负责，并同意不发布任何违法、有害或不适当的内容。

如果您在个人资料中添加了外部社交媒体或网站的链接（包括艺术家主页），这些链接将对公众可见。我们不验证或监控这些链接。您对通过外部服务分享的所有数据承担全部责任。

Community保留自行决定任何用户内容是否适当并符合本条款的权利，包括拒绝或删除该内容的权利，但无义务。此外，Community保留对内容格式进行编辑和修改的权利，并可更改其展示方式。如果您发布了令人反感的用户内容，Community有权限制或撤销您使用本服务的权限。

由于Community无法控制服务中所有用户或第三方发布的内容，您需自行承担使用本服务的风险。您理解并接受，使用本服务可能会接触到您认为令人反感、不准确、不雅或不当的内容，且Community对任何内容（包括错误、遗漏）或因此造成的任何损失或损害不承担任何责任。

5. 数据收集与使用

我们仅收集有限数据，以提升用户体验，包括展览浏览记录、收藏、订阅，以及对地图、日历和明信片等功能的使用行为。

如果您通过 Open ID 提供商（如 Google、Apple、Yahoo! Japan、LINE 等）登录，我们可能会在您授权的情况下收到您的电子邮件地址。该邮箱地址会被安全地存储在 Firebase 中，并仅用于发送不定期的通知或新闻通讯。您可通过电子邮件中的退订链接随时取消订阅。即使身份提供商共享了您的真实姓名或姓氏，我们也不会存储或使用这些信息。

我们不会收集或存储您的精确 GPS 位置。对位置信息的访问仅在需要支持路线规划或访问确认等功能时临时使用，不会被存储或外部传输。

根据《个人信息保护法》（APPI），任何可识别个人的信息（如设备标识符、账户 ID 或综合使用数据）都将被严格保护。用户有权请求访问、更正或删除其个人数据。

6. 位置与导航

位置服务仅用于提升与地理位置相关的功能，例如计算当前位置与附近画廊的距离、根据位置推荐展览，以及确认参展打卡。

您的位置数据仅在您主动使用相关功能（如路线规划或到场确认）时被临时访问。所有定位处理均在您的设备本地进行，Community 不会存储、记录或传输您的位置数据至外部服务器或第三方。

我们不会持续追踪您的位置，您可以随时通过设备系统设置管理或关闭位置访问。关闭定位服务可能会限制部分功能的使用，但不会影响整个应用的基本功能。

7. 通信与消息

本应用提供基础的消息功能，用于用户之间协调，如发送展览邀请或组织参观活动。请注意：此功能不支持加密，您的消息内容在传输过程中可能会被访问。强烈建议您不要通过此功能发送任何私人、敏感或可识别身份的信息。

因使用该消息功能导致的任何后果或泄露信息，Community概不负责。用户应仅就展览、活动及相关协调进行交流。禁止将该功能用于商业推广、骚扰或任何形式的垃圾信息传播。如有滥用行为，可能导致账户限制或注销。

8. 通知

我们提供完善的通知系统，帮助您节省时间并随时了解相关更新。经您授权，应用可能在以下情况下向您的设备发送推送通知：(i) 当您订阅艺术家时；(ii) 当您订阅画廊时；(iii) 当您收藏展览或已收藏的展览有更新时；(iv) 当您收到来自其他用户的新消息时；(v) 当 Community 发布公告（广播）时。

您可随时在应用的“设置”中管理通知偏好，包括选择接收的类别或完全关闭通知。您收到的通知数量取决于您的使用活动、订阅和收藏；一般而言，我们通常每周发送不超过 5 条通知。通知的送达还可能受您的设备和操作系统设置影响；如在系统层面关闭通知，将无法接收。

9. 数据存储与传输

通过本应用收集的数据可能会存储在您所在国家/地区之外的服务器上，包括一些数据保护法律不如您本国严格的地区。使用本应用即表示您同意将您的个人数据跨境传输。

对于日本用户，所有个人数据的跨境传输将依据《个人信息保护法（APPI）》进行，确保其获得等效水平的保护。

10. 行为准则

您同意在任何时候以尊重、合法且不扰乱他人的方式使用本应用。这包括：不得骚扰、欺凌或恐吓其他用户；不得使用仇恨言论、歧视性语言、露骨或冒犯性内容；不得上传或分享诽谤、淫秽、非法或侵犯他人权利的内容。

消息功能不得用于垃圾信息、未经请求的推广或人身攻击。禁止冒充他人、组织或艺术家，禁止绕过访问控制、内容审核或其他安全机制。

任何试图破坏应用完整性的行为，例如黑客攻击、逆向工程或利用漏洞，都是严格禁止的。用户还对自己通过应用发送的所有消息内容承担全部责任。Community不对用户发起的攻击性、威胁性或非法通信造成的损害承担责任，但保留删除该类内容并暂停或永久关闭相关账户的权利。

Community可监控用户行为、内容提交及通信，以确保遵守本条款，并为所有用户维持建设性、包容性的环境。如有严重或重复违规行为，将导致账户永久停用、内容删除，或在必要时通报执法机关。

11. 内容准确性免责声明

尽管我们尽合理努力确保应用中显示的信息（包括展览详情、画廊时间、艺术家名称和地点）在发布时是准确、完整且最新的，但Community无法保证所有数据的完全可靠性或时效性。

本应用中的许多内容由第三方提供，如画廊、策展人、艺术家或自动信息源，可能会有临时变更，超出我们的控制范围。

对于因第三方提交或更新延迟而导致的过时、错误或缺失信息，Community不承担责任。因此，我们不对内容的准确性、可用性或完整性作出任何明示或暗示的保证。

我们强烈建议用户在前往参观前，直接联系相关画廊、主办方或艺术家，确认展览的具体信息（包括起止时间、开放时间、地址和入场政策）。因依赖应用信息而引发的任何不便、损失或误解，Community概不负责。

本应用严格遵循不发布与正在发生或近期武装冲突相关的展览信息、军事宣传、煽动民族或国家仇恨、对战争的政治化解读、美化军事冲突参与者或类似内容的政策。此限制旨在维护一个与本应用使命相符的、尊重、中立且安全的信息环境—即以介绍文化活动，特别是摄影和艺术领域的内容为主，而非政治或军事主题。

若任何内容（包括展览海报、文字描述、图片、消息或外部链接等）包含可能被视为支持或美化军事行动、暴力或政治侵略的元素或信息，我们保留拒绝提交或删除相关内容的权利。

用户理解并同意，针对上述内容的审核决定完全由本应用管理方自行裁量作出，且无义务提供详细解释。这些决定旨在确保用户安全并遵循普遍认可的道德标准。

12. 知识产权

本服务及其所有原创内容，包括但不限于应用设计、用户界面组件、图标、布局结构、源代码（不包括开源部分）、图像、图形、品牌元素和文本，均为Community或其授权方的独有财产，并将始终如此。

上述所有内容受日本及其他司法辖区的著作权、商标权及其他相关知识产权法保护。未经Community事先书面许可，严禁擅自复制、分发、修改、逆向工程或以任何形式使用这些受保护的内容，无论是用于商业还是非商业目的。

应用中出现的所有商标、服务标志、商号、徽标或产品外观设计均为Community或其第三方权利人所有的注册或未注册标识，未经明确书面授权，禁止全部或部分复制、模仿或使用。您无权根据本条款获得对任何Community知识产权的许可或使用权，除非已获得Community事先书面同意。

13. 知识产权侵权

Community尊重他人的知识产权。我们会在收到关于通过服务发布的内容侵犯著作权或其他知识产权的声明后采取适当措施。

如果您是著作权所有者或有权代表其行事，且认为本服务中某内容侵犯了您的著作权，请发送书面通知至我们的版权代理人邮箱：support@communityapp.jp，并附上涉嫌侵权的详细描述。请注意，如您故意虚假陈述内容侵犯您的版权，您可能需承担包括赔偿金及律师费用在内的法律责任。

14. 第三方服务

本应用可能包含指向第三方服务的链接或集成，例如地图、分析工具、社交媒体平台等。Community 不对这些外部服务的内容、条款或隐私做法负责。建议您在通过本应用使用这些服务前，先阅读其相关条款和隐私政策。

为了实现相关功能，本应用集成了以下第三方工具和SDK，这些服务的使用范围有限，且以隐私为导向的方式集成。使用本应用即表示您同意以下服务的使用：

Firebase Firestore：用作实时云数据库，用于存储展览收藏、浏览记录以及其他应用相关数据。它还与 Firebase Authentication 一起使用，用于通过第三方身份提供商（如 Google、Apple、Yahoo! Japan、LINE）进行 Open ID 登录管理。用户登录时，在获得许可的前提下，我们会安全地将您的邮箱地址存储在 Firestore 中，仅用于发送新闻通讯。我们不会存储这些身份提供商提供的真实姓名、姓氏或其他个人数据。
Google Maps SDK：用于探索附近展览、导航和搜索画廊。SDK 可能访问临时的大致位置，但不会存储或传输用户的位置信息。请参阅 Google Maps 政策以了解更多详情。
Apple Maps：在用户请求时用于从当前位置到画廊构建路线。坐标仅用于导航，不被本应用存储或收集。
第三方身份认证服务（Google、Apple、Yahoo! Japan、LINE 等）：这些服务允许用户使用已有账户安全登录。认证完成后，我们可能会收到用户的邮箱地址和唯一标识符。邮箱地址仅用于可选的新闻通讯发送，绝不会被共享。唯一标识符仅用于内部关联用户会话或偏好设置，不用于跟踪或用户画像。如果收到真实姓名或显示名称，我们也不会存储或使用
TOCropViewController：在创建头像时本地裁剪用户上传的照片。该功能不涉及外部数据传输。
SwiftSoup：用于解析展览描述和富文本内容，不会收集或传输用户数据。
SwiftUIPager：在内部用于实现平滑的照片滚动。它仅处理用户界面布局，不收集或传输任何用户数据。
RichTextKit：支持用户生成内容中的文本格式化功能，仅在本地操作，不涉及外部处理。
Push Notifications：用于发送提醒、展览邀请和更新通知。通知仅在用户授权下发送，用户可在设备设置中随时关闭。

15. 账户终止

若Community判断您违反本条款、损害其他用户或平台，或不当使用应用功能，我们有权在无需事先通知的情况下，随时暂停、限制或永久终止您对本应用的访问。包括但不限于欺诈行为、身份冒用、辱骂行为或发布违法、有害内容。严重或重复违规行为将可能导致账户立即被停用，相关数据被删除。

此外，如因法律或监管要求，或继续访问会对Community构成安全、法律或声誉风险，账户也可能被终止。

16. 责任限制

Community按“原样”提供本应用，并不作出任何明示或暗示的保证。虽然在发布前已进行了广泛测试且未发现问题，但我们不保证本应用持续运行或无错误。如同其他软件一样，也可能出现不可预见的漏洞或故障。您使用本应用的风险由您自行承担。

Community保留在任何时间、因任何原因（包括但不限于系统维护、诊断、安全补丁、功能升级或紧急情况）暂停、限制或关闭应用的权利。如为计划内维护，我们将尽量提前通知用户；但在紧急或无法预料的情况下，可能会发生无预警的服务中断。我们将努力减少对用户的影响，但不保证服务不中断或用户体验持续不变。

虽然我们会定期备份用户内容，但Community不保证数据不会丢失或损坏。例如：备份前内容已损坏，或在备份过程中发生变更，都可能导致无效或不完整的备份。Community可能提供支持并尝试排查已知问题，但对于内容是否可恢复或完整性问题，我们不承担任何责任。

17. 平台提供商免责声明

Community不对Apple Inc.、Google LLC 等平台提供商的政策、操作或行为负责。这些提供商可能制定各自的服务条款、隐私政策和运行要求，Community无法控制。

对于因平台提供商的决定或执行行为所导致的中断、限制或下架（例如应用临时不可用、被拒或被暂停，或因政策更新而被要求进行更改），Community不承担责任。建议用户仔细阅读相关平台的使用条款，以了解适用规则。

18. 日本与美国法律合规

您在此声明并保证：(i) 您当前不在、也未从日本或美国政府实施贸易禁运或制裁的国家/地区访问本应用（包括被认定为“支持恐怖主义”的国家）；(ii) 您不在任何政府发布的限制或禁止名单中，包括美国财政部的 Specially Designated Nationals (SDN) 清单或日本政府发布的类似名单。

违反上述规定使用本应用将被严格禁止，并可能导致账号立即被终止，并通报相关政府机构。

19. 不可抗力

Community不对因无法合理控制的事件所导致的延迟、中断或服务故障承担任何责任，包括但不限于自然灾害（如地震、洪水、风暴）、政府行为、战争或恐怖主义行为、劳资纠纷、停电、通信或网络故障、技术故障、疫情或公共卫生紧急事件等。

在此类情况下，Community可临时中断或限制应用访问，无需承担责任。如可能，我们将尽力提前通知用户，但在紧急或突发情况下，可能无法提供预先通知。我们将尽量减小对用户的影响，但无法作出任何保证。

20. 适用法律与管辖权

本条款适用日本法律，并依其解释。如存在多语言版本不一致的情况，以日文版本为准。

21. 可分割性条款

若本条款的任何条文在适用法律下被认定为无效或无法执行，其余条款仍应保持完全效力。

22. 隐私政策

使用本应用即表示您同意我们的隐私政策，该政策规定了我们如何处理您的个人数据。当前版本可在应用的用户设置界面中随时查看。

23. 条款变更

Community保留随时更新本条款的权利。条款更新后继续使用应用即表示您接受更新后的条款。

이 이용약관(이하 “약관”)은 사진 전시 탐색 및 방문 계획을 위한 Community 애플리케이션 (이하 “Community”, “앱”, “당사”)의 사용을 규정합니다. 앱을 사용함으로써 귀하는 본 약관에 동의하는 것으로 간주됩니다. 약관에 동의하지 않는 경우, 앱을 사용하지 마십시오.

1. 앱 사용

귀하는 본 약관에 따라 전시를 탐색하고, 이벤트를 북마크하며, 인상(impression)을 게시하고, 상을 수여하며, 커뮤니티 활동에 참여할 수 있습니다.

2. 연령 제한

앱을 사용하려면 만 18세 이상이어야 합니다. 앱에 접속하거나 사용하는 것은 귀하가 만 18세 이상이며 법적으로 본 약관에 동의할 수 있는 자격이 있음을 보증하는 것입니다. 18세 미만은 계정을 만들거나 콘텐츠를 게시하거나 앱의 기능을 사용할 수 없습니다.

Community는 18세 미만 아동의 정보를 의도적으로 수집하거나 요청하지 않습니다. 미성년자 사용자임이 확인될 경우, 당사는 즉시 해당 계정을 종료하고 관련 데이터를 삭제할 권리를 보유합니다. 귀하는 자신의 지역에서의 연령 규정을 준수할 책임이 있으며, Community는 나이 허위 기재에 대해 책임지지 않습니다. 허위 기재 시 계정 정지, 콘텐츠 삭제, 필요 시 법적 기관에 통보될 수 있습니다.

3. 사용자 계정

Community에서 계정을 생성할 때, 귀하는 항상 정확하고 완전하며 최신 정보를 제공해야 합니다. 이를 준수하지 않으면 약관 위반으로 간주되며, 계정이 즉시 종료될 수 있습니다.

귀하는 자신의 비밀번호를 안전하게 보관해야 하며, 해당 비밀번호로 이루어진 모든 활동에 대해 책임을 집니다. 비밀번호는 제3자에게 공유해서는 안 됩니다.

보안 위반이나 무단 사용이 의심될 경우 즉시 Community에 알려야 합니다. 사용자 이름은 타인의 이름, 상표, 법적으로 사용이 제한된 이름, 혹은 불쾌감이나 외설적인 표현을 포함해서는 안 됩니다. 작가로 등록할 경우, 타인이나 조직을 사칭하거나 작품의 저작권, 소속, 소유권에 대해 허위 정보를 제공해서는 안 됩니다. 이는 사기 행위로 간주되며, 즉시 계정 정지 및 필요한 경우 법적 조치를 받을 수 있습니다.

4. 사용자 콘텐츠

앱에서는 감상, 댓글, 메시지 등 사용자가 콘텐츠(“사용자 콘텐츠”)를 업로드, 게시 또는 공유할 수 있습니다. 사용자는 해당 콘텐츠에 대한 소유권을 유지하지만, Community는 전 세계적으로 비독점적이며 로열티 없는 방식으로 콘텐츠를 사용, 복제 및 표시할 수 있는 라이선스를 부여받습니다. 사용자는 자신의 콘텐츠에 대해 전적으로 책임지며, 불법적이거나 해롭거나 부적절한 내용을 게시하지 않기로 동의합니다.

외부 SNS 또는 웹사이트(작가 페이지 포함)에 대한 링크를 프로필에 포함하는 경우, 해당 링크는 공개됩니다. Community는 이러한 링크를 확인하거나 모니터링하지 않으며, 외부 서비스와 관련된 데이터 공유는 사용자 책임입니다.

Community는 사용자 콘텐츠가 적절하고 본 약관에 부합하는지 여부를 단독 재량으로 판단할 수 있으며, 이를 거부하거나 삭제할 권리가 있지만 의무는 없습니다. 또한 콘텐츠의 형식 및 표현 방식을 편집하거나 변경할 수 있는 권리를 보유하며, 부적절한 콘텐츠를 게시할 경우 서비스 이용을 제한하거나 철회할 수 있습니다.

Community는 서비스 내에 게시되는 모든 사용자 또는 제3자의 콘텐츠를 통제할 수 없으므로, 사용자는 본 서비스를 본인의 책임하에 이용함에 동의합니다. 사용 중 불쾌하거나, 부정확하거나, 외설적이거나, 부적절한 콘텐츠를 접할 수 있으며, 이러한 콘텐츠로 인해 발생하는 손해나 손실에 대해 Community는 책임을 지지 않습니다.

5. 데이터 수집 및 사용

우리는 사용자 경험 향상을 위해 전시 조회 수, 즐겨찾기, 구독, 지도・달력・엽서 기능과의 상호작용 등 제한된 데이터를 수집합니다.

Google, Apple, Yahoo! Japan, LINE 등의 Open ID 제공자를 통해 로그인하는 경우, 사용자가 동의한 경우에 한해 이메일 주소를 받을 수 있습니다. 이 이메일 주소는 Firebase에 안전하게 저장되며, 가끔 발송되는 뉴스레터 및 알림에만 사용됩니다. 이메일 내 수신 거부 링크를 통해 언제든지 수신을 취소할 수 있습니다. 인증 제공자가 공유한 실명이나 성은 저장하거나 사용하지 않습니다.

정확한 GPS 위치 정보는 수집하거나 저장하지 않습니다. 위치 정보 접근은 경로 계산이나 방문 확인 등 특정 기능을 일시적으로 지원하는 용도로만 요청되며, 저장되거나 외부로 전송되지 않습니다.

개인정보보호법(APPI)에 따라, 디바이스 식별자, 계정 ID 또는 사용 데이터 조합 등 개인을 식별할 수 있는 정보는 엄격하게 보호됩니다. 사용자는 자신의 개인 데이터에 대한 접근, 수정 또는 삭제를 요청할 권리를 가지고 있습니다.

6. 위치 및 내비게이션

Community는 현재 위치와 인근 갤러리 간의 거리 확인, 위치 기반 전시 추천, 방문 시 출석 확인 등을 위한 위치 기반 기능 향상에만 위치 서비스를 사용합니다.

위치 정보는 사용자가 경로 계획 또는 출석 확인과 같은 기능을 직접 사용할 때에만 일시적으로 접근되며, 모든 위치 처리 과정은 기기 내에서만 수행됩니다. Community는 사용자의 위치 데이터를 저장하거나 외부 서버 또는 제3자에게 전송하지 않습니다.

지속적인 위치 추적은 전혀 이루어지지 않으며, 사용자는 언제든지 기기 설정에서 위치 접근을 관리하거나 비활성화할 수 있습니다. 위치 서비스를 끄면 일부 기능은 제한될 수 있으나, 앱 전체 이용에는 영향이 없습니다.

7. 커뮤니케이션 및 메시지 기능

본 앱에는 전시 초대 또는 그룹 방문 일정 조율과 같은 사용자 간 협력을 위한 기본 메시지 기능이 포함되어 있습니다. 이 메시지 기능은 암호화되어 있지 않으며, 전송 중 메시지 내용이 노출될 수 있습니다. 개인 정보나 민감한 내용을 메시지를 통해 주고받는 것은 삼가 주시기 바랍니다.

Community는 메시지 기능의 오용 또는 개인정보 공유로 인한 결과에 대해 책임지지 않습니다. 메시지는 전시, 행사 및 조율과 직접 관련된 대화로 제한되어야 하며, 상업적 홍보, 괴롭힘, 스팸 등으로 사용하는 것은 금지됩니다. 남용 시 계정 제한 또는 종료 조치가 취해질 수 있습니다.

8. 알림

사용자의 시간을 절약하고 관련 업데이트를 빠르게 확인할 수 있도록 종합적인 알림 시스템을 제공합니다. 사용자의 동의가 있는 경우, 다음 상황에서 기기로 푸시 알림이 전송될 수 있습니다: (i) 아티스트를 구독할 때, (ii) 갤러리를 구독할 때, (iii) 전시를 북마크하거나 북마크한 전시가 업데이트될 때, (iv) 다른 사용자로부터 새 메시지를 받을 때, (v) Community가 방송(공지)을 게시할 때.

알림 수신 설정은 앱의 ‘설정’에서 언제든지 관리할 수 있으며, 수신할 카테고리를 선택하거나 알림을 완전히 끌 수 있습니다. 수신하는 알림 수는 사용 활동, 구독, 북마크에 따라 달라지며, 일반적으로 주당 5건을 넘지 않습니다. 알림 전달은 기기 및 운영체제 설정에 따라 달라질 수 있으며, 시스템 수준에서 알림을 비활성화하면 수신되지 않습니다.

9. 데이터 저장 및 전송

앱을 통해 수집된 데이터는 사용자의 거주 국가 외 지역에 위치한 서버에서 저장 및 처리될 수 있습니다. 이에는 사용자의 국가와 동일한 수준의 개인정보 보호법이 없는 국가도 포함될 수 있습니다. 앱을 사용함으로써 사용자는 자신의 개인정보가 국외로 전송되는 것에 동의하는 것으로 간주됩니다.

일본 사용자에 한해서는, 개인정보의 국외 전송은 「개인정보 보호법(APPI)」에 따라 동일한 수준의 보호가 보장되는 방식으로 처리됩니다.

10. 이용자 행동

사용자는 항상 존중하고, 합법적이며, 방해되지 않는 방식으로 앱을 이용할 것에 동의합니다. 이는 타 이용자에 대한 괴롭힘, 따돌림, 협박 행위의 금지, 혐오 표현, 차별적 언어, 외설적 또는 불쾌한 콘텐츠의 사용 금지, 그리고 비방, 음란, 불법 또는 타인의 권리를 침해하는 자료의 업로드나 공유 금지를 포함합니다.

메시지 기능은 스팸, 무단 홍보, 인신 공격 등의 목적으로 사용할 수 없습니다. 타인, 단체 또는 예술가를 사칭하거나, 접근 제어, 콘텐츠 검열 시스템 또는 보안 기능을 우회하는 행위는 금지됩니다.

해킹, 리버스 엔지니어링, 취약점 악용 등 앱의 무결성을 훼손하려는 시도는 엄격히 금지됩니다. 사용자는 앱 내에서 전송하는 메시지의 내용에 대해 전적으로 책임을 집니다. Community는 공격적, 위협적 또는 불법적인 메시지로 인한 피해에 대해 책임을 지지 않지만, 해당 콘텐츠를 삭제하고 계정을 정지 또는 영구적으로 종료할 권리를 보유합니다.

Community는 약관 준수 여부 및 모든 사용자를 위한 건전하고 포용적인 환경을 유지하기 위해 사용자 행동, 콘텐츠 제출 및 커뮤니케이션을 모니터링할 수 있습니다. 반복적이거나 심각한 위반 시, 계정의 영구 정지, 콘텐츠 삭제 또는 필요 시 법 집행 기관에 신고될 수 있습니다.

11. 콘텐츠 정확성 고지

Community는 앱에 표시되는 정보(전시 세부 정보, 갤러리 운영 시간, 아티스트 이름, 장소 등)가 게시 시점에서 정확하고 완전하며 최신 상태일 수 있도록 합리적인 노력을 다하고 있습니다. 그러나 해당 정보의 절대적인 신뢰성과 시의성을 보장할 수는 없습니다.

앱 내 콘텐츠는 갤러리, 큐레이터, 작가 또는 자동 피드 등 제3자로부터 제공되며, 갑작스러운 변경이 발생할 수 있습니다. 외부 제출 또는 업데이트 지연으로 인한 정보 누락, 오류에 대해 Community는 책임지지 않습니다.

따라서 Community는 콘텐츠의 정확성, 이용 가능성 또는 완전성에 대해 명시적 또는 묵시적인 어떠한 보증도 하지 않습니다. 사용자는 전시 방문 전, 전시 시작/종료일, 운영 시간, 장소, 입장 정책 등의 세부 정보를 관련 갤러리, 주최자 또는 작가에게 직접 확인할 것을 강력히 권장합니다. 앱의 전시 정보를 신뢰하여 발생한 불편, 손실 또는 오해에 대해 Community는 책임을 지지 않습니다.

본 앱은 현재 또는 최근의 무력 충돌과 관련된 전시 정보, 군사 선전, 민족적·국가적 증오를 조장하는 내용, 전쟁의 정치적 해석, 군사 분쟁 참여자의 미화 및 이와 유사한 콘텐츠를 게재하지 않는 엄격한 정책을 따르고 있습니다. 이는 앱의 사명인 사진 및 예술 분야의 문화 이벤트를 소개하는 목적에 부합하며, 정치적 또는 군사적 주제가 아닌 존중되고 중립적이며 안전한 정보 환경을 유지하기 위함입니다。

또한, 제출된 콘텐츠(전시 포스터, 설명, 이미지, 메시지, 외부 링크 등을 포함)가 군사 행동, 폭력 또는 정치적 침략을 지지하거나 미화하는 것으로 인식될 수 있는 요소나 메시지를 포함할 경우 게재 거부 또는 삭제할 권리를 보유합니다.

사용자는 이와 같은 콘텐츠에 대한 조정(모더레이션) 결정이 앱 운영자의 단독 재량에 따라 이루어지며, 자세한 설명 의무가 없다는 것을 인지하고 동의합니다. 이러한 결정은 사용자 안전을 보장하고 널리 인정되는 윤리 기준을 준수하기 위한 것입니다.

12. 지식재산권

본 서비스 및 해당 서비스에 포함된 모든 독창적인 콘텐츠(앱 디자인, 사용자 인터페이스 구성요소, 아이콘, 레이아웃 구조, 소스 코드(오픈소스 제외), 이미지, 그래픽, 브랜딩 요소, 텍스트 등을 포함하되 이에 한정되지 않음)는 Community 및 그 라이선스 제공자의 독점 재산이며, 앞으로도 그러합니다.

앱에 나타나는 상표, 서비스 마크, 상호, 로고 또는 트레이드 드레스는 Community 또는 제3권리자의 등록/미등록 자산이며, 명시적인 사전 승인 없이 전부 또는 일부를 복사하거나 모방하거나 사용하는 것은 금지됩니다。본 약관은 사용자가 Community의 지식재산권을 사용할 수 있는 어떤 권리나 라이선스도 부여하지 않습니다。

13. 지식재산권 침해

귀하가 저작권자이거나 그 대리인이고, 서비스에서 제공되는 콘텐츠가 귀하의 저작권을 침해하고 있다고 판단되는 경우, 다음 이메일 주소 support@communityapp.jp 로 저작권 침해 내용을 상세히 기재한 서면 통지를 제출해 주시기 바랍니다。허위로 침해 사실을 주장한 경우, 손해배상(소송 비용 및 변호사 비용 포함)의 책임이 발생할 수 있습니다。

14. 제3자 서비스

본 앱은 지도, 분석, 소셜 미디어 플랫폼 등의 제3자 서비스와의 링크 또는 통합을 포함할 수 있습니다. Community는 이러한 외부 서비스의 콘텐츠, 약관 또는 개인정보 보호 관행에 대해 책임지지 않습니다. 앱을 통해 제3자 서비스와 상호작용하기 전에 해당 서비스의 약관 및 정책을 검토할 것을 권장합니다.

앱은 다음과 같은 제3자 도구 및 SDK를 통합하여 기능을 제공합니다. 이들 서비스는 제한적인 범위에서 사용되며 개인정보 보호를 고려하여 통합되어 있습니다. 앱을 사용함으로써 아래 서비스의 사용에 동의한 것으로 간주됩니다.

Firebase Firestore: 전시 북마크, 인상 기록, 기타 앱 관련 데이터를 실시간으로 저장하는 클라우드 데이터베이스로 사용됩니다. 또한 Google, Apple, Yahoo! Japan, LINE 등 서드파티 인증 제공자를 통한 Open ID 기반 로그인 관리를 위해 Firebase Authentication과 함께 사용됩니다. 로그인 시, 사용자가 허용한 경우 이메일 주소가 Firestore에 안전하게 저장되며, 이는 뉴스레터 발송에만 사용됩니다. 인증 제공자가 제공한 실명, 성, 기타 개인 정보는 저장하지 않습니다.
Google Maps SDK: 근처 전시 탐색, 길찾기, 갤러리 검색을 지원합니다. 임시 위치 데이터에 접근할 수 있으나, 위치 이력은 저장하거나 전송되지 않습니다. 자세한 정보는 Google Maps 정책을 참조하세요.
Apple Maps: 요청 시 사용자의 위치에서 갤러리까지 경로를 생성합니다. 좌표는 Apple Maps에만 전송되며 앱에서는 저장하거나 수집하지 않습니다.
서드파티 인증 제공자(Google, Apple, Yahoo! Japan, LINE 등): 이러한 서비스는 사용자가 기존 계정을 통해 안전하게 로그인할 수 있도록 합니다. 인증 후 이메일 주소와 고유 사용자 식별자가 수신될 수 있습니다. 이메일 주소는 선택적인 뉴스레터 발송에만 사용되며, 제3자에게 공유되지 않습니다. 고유 식별자는 세션이나 사용자 설정을 연결하기 위한 내부 용도로만 사용되며, 추적이나 프로파일링에는 사용되지 않습니다. 실명이나 표시명이 제공되더라도, 해당 정보는 저장하거나 사용하지 않습니다.
TOCropViewController: 아바타 생성 시 사용자 제공 사진을 로컬에서 자르기 위해 사용됩니다. 이 기능의 데이터는 외부로 전송되지 않습니다.
SwiftUIPager: 내부적으로 부드러운 사진 스크롤을 구현하는 데 사용됩니다. UI 레이아웃만 처리하며, 사용자 데이터를 수집하거나 전송하지 않습니다.
SwiftSoup: 전시 설명 및 콘텐츠 피드의 파싱을 위해 내부적으로 사용되며, 사용자 데이터를 수집하거나 전송하지 않습니다.
RichTextKit: 사용자 생성 콘텐츠(인상 등)의 고급 텍스트 서식을 지원합니다. 로컬에서 작동하며 외부 데이터 처리나 전송은 없습니다.
Push Notifications: 전시 알림, 초대, 업데이트 등을 전송합니다. 알림은 사용자 허용 시에만 제공되며, 장치 설정에서 언제든지 비활성화할 수 있습니다.

15. 이용 해지

Community는 사용자가 본 약관을 위반하거나, 다른 사용자 또는 플랫폼에 피해를 주었거나, 앱 또는 기능을 부당하게 사용했다고 판단할 경우, 사전 통보 없이 언제든지 액세스를 제한, 중지 또는 영구 해지할 수 있습니다. 여기에는 사기 행위, 사칭, 공격적 행동, 불법 또는 유해한 콘텐츠 게시 등이 포함됩니다. 반복적이거나 중대한 위반은 즉시 계정 비활성화 및 데이터 삭제로 이어질 수 있습니다.

또한 법률 또는 규제 요구사항, 또는 지속적인 접근이 Community에 보안, 법적, 평판상 위험을 초래할 경우에도 계정 종료가 이루어질 수 있습니다。

16. 책임의 제한

Community는 본 앱을 “있는 그대로” 제공하며, 명시적 또는 묵시적인 어떠한 보증도 하지 않습니다. 출시 전 철저한 테스트를 거쳤지만, 앱이 항상 중단 없이 완벽하게 작동할 것을 보장하지 않습니다. 모든 소프트웨어와 마찬가지로, 예기치 못한 오류나 문제는 언제든지 발생할 수 있으며, 사용자는 스스로의 책임 하에 앱을 사용해야 합니다。

Community는 시스템 점검, 진단, 보안 패치, 기능 업데이트, 긴급 조치 등을 포함하여 다양한 사유로 언제든지 앱의 작동을 일시 중단, 제한 또는 비활성화할 수 있는 권리를 보유합니다. 예정된 유지보수의 경우 사전 공지를 위해 합리적인 노력을 다하겠지만, 긴급하거나 예상치 못한 상황에서는 사전 안내 없이 서비스 중단이 발생할 수 있습니다. 우리는 사용자의 불편을 최소화하려 최선을 다하지만, 중단 없는 접근이나 완전한 사용자 경험의 지속을 보장하지는 않습니다.

정기적으로 사용자 콘텐츠의 백업을 수행하나, Community는 데이터 손실 또는 손상의 가능성을 완전히 배제할 수 없습니다. 예를 들어 백업 전 이미 손상된 콘텐츠, 백업 도중 변경된 콘텐츠 등은 유효하지 않은 복원 지점을 초래할 수 있습니다. Community는 이러한 문제에 대해 지원을 제공하고 해결을 시도할 수 있지만, 사용자 콘텐츠의 무결성이나 복구 성공에 대한 책임은 지지 않습니다.

17. 플랫폼 제공자 관련 면책

Community는 Apple Inc., Google LLC 등 플랫폼 제공자의 정책, 운영 방식 또는 조치에 대해 어떠한 책임도 지지 않습니다. 이들 제공자는 자사의 서비스 약관, 개인정보 보호 정책, 운영 요건을 정할 수 있으며, 이는 Community의 통제를 벗어납니다.

플랫폼 제공자의 결정 또는 조치로 인해 발생하는 앱의 중단, 제거, 제한(예: 앱 사용 불가, 검수 거절, 서비스 중단, 정책 변경으로 인한 수정 요구 등)에 대해 Community는 책임을 지지 않습니다. 사용자는 앱 사용에 관련된 플랫폼의 약관을 스스로 확인하고 이해할 것을 권장합니다。

18. 일본 및 미국 법률 준수

사용자는 다음 사항을 보증합니다: (i) 귀하는 현재 일본 또는 미국 정부가 무역 제재나 기타 제재를 시행하는 국가(예: 테러 지원국 등)에서 거주하거나 해당 국가에서 앱을 사용하고 있지 않으며, (ii) 귀하는 미국 재무부의 Specially Designated Nationals (SDN) 목록 또는 일본 정부가 발행한 유사한 금지/제한 명단에 포함되어 있지 않습니다.

이러한 제한을 위반하여 앱을 사용하는 행위는 엄격히 금지되며, 즉시 계정 종료 및 관련 당국에 보고될 수 있습니다。

19. 불가항력

Community는 예측 가능 여부와 관계없이, 그 합리적 통제를 벗어난 사유로 인해 발생한 지연, 장애 또는 성능 저하에 대해 어떠한 책임도 지지 않습니다. 여기에는 천재지변(지진, 홍수, 폭풍 등), 정부 조치, 전쟁, 테러, 노동 분쟁, 정전, 통신 또는 인터넷 장애, 기술적 고장, 팬데믹, 공중 보건 비상사태 등이 포함됩니다.

이러한 상황에서는 Community가 사전 고지 없이 일시적으로 앱 접근을 중단하거나 제한할 수 있으며, 이에 대해 책임을 지지 않습니다. 사전에 예측 가능한 경우 사용자에게 안내하려 노력하겠지만, 긴급 상황에서는 불가능할 수 있습니다. 우리는 사용자에 대한 영향을 최소화하려 최선을 다하겠습니다만, 이를 보장할 수는 없습니다。

20. 준거법 및 관할권
